Neocron Terms of Service
Welcome to Neocron. The Neocron Service is comprised of two components: (i) the Neocron Client software and documentation, and (ii) the Neocron online service represented by the game Servers, communication between Client and Servers, and all related online content including the official Neocron community websites and discussion forums. Your non-exclusive use of the Neocron Client is subject to these Terms of Registration.
Neocron is an online Massively Multiplayer Roleplaying Game ("MMORPG") that is played exclusively online while connected to an official Neocron Server. Neocron is managed and maintained by a global volunteer support staff ("Neocron Support Team") with authorisation and oversight by the respective holders of the Neocron intellectual property.
I. LIMITED LICENSE
In order to play Neocron you must first register as a Player and install the Neocron Client software program. Subject to your confirmation of and continued compliance with this Agreement you may use the Neocron Service solely for your own entertainment purposes via an officially distributed unmodified Neocron Client. You may electronically copy and re-distribute copies of the Neocron Client for non commercial use only. You are not permitted to sell or trade in any material related to the Neocron Service without prior written authorisation of the Neocron Support Team. You may not use the Neocron Service for any other purpose, or in connection with any other software not officially endorsed by the Neocron Support Team.
II. ELIGIBILITY
You assert that you have reached the age of maturity as stipulated by the laws of your country of residence. Should that not be the case you must provide consent from a parent or legal guardian. You may also be required to provide conclusive proof of identity at the Neocron Support Team’s sole discretion. If at any time you are found to be ineligible your account may be suspended or permanently revoked.
II. COMMERCIAL TERMS
At this time there are no fees or charges associated with any part of the Neocron Service whatsoever. The Neocron Support Team reserves the right to institute such fees in the future, with any such changes advertised in advance.
IV. TERMINATION
This license is valid until terminated by one of the contracted parties. This licensing agreement and your game and/or forum accounts will be terminated immediately by the Neocron Support Team if you fail to abide by the terms of this license:
- In the case of repeated or severe offences against the Neocron Terms of Service. A warning is not required in the case of severe offences.
- In the case of repeated or severe offences against the Neocron Rules of Conduct. A warning is not required in the case of severe offences.
- In the case of repeated or severe offences against the Neocron Forum Rules. A warning is not required in the case of severe offences.
Should your game or forum account(s) be terminated we will aim to notify you of the reasons for our decision via your registered email address. We reserve the right to cancel your account(s) and any other account(s) we believe to be associated with you at our sole discretion and without further discussion.
V. WARRANTY
THE NEOCRON SUPPORT TEAM DOES NOT MAKE ANY OTHER REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, WITH REGARD TO SERVICES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, AVAILABILITY AND FITNESS FOR PARTICULAR PURPOSE.
VI. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, the Neocron Support Team will not be liable for any specific, incidental, indirect or consequential damage, arising out of the use of or inability to use this software product. This limitation remains valid even if the Neocron Support Team has previously advised of the possibility of such damage.
VII. FORCE MAJEURE
The Neocron Support Team will not be liable for failure to perform any of its obligations hereunder where such performance is prevented or interfered with by any cause beyond the Neocron Support Team’s reasonable control.
VIII: SEVERABILITY
These conditions form the entire agreement between you and the Neocron Support Team with respect to the use of the Neocron Service. If any term in these conditions is determined by a court to be illegal, invalid or in any way unenforceable, that provision shall be severed from these conditions and the remaining provisions shall continue in full force and effect.
IX: JURISDICTION AND GOVERNING LAW
These conditions shall be governed by and construed in accordance with the laws of Germany. As the Neocron Service can be accessed from other places around the world with different laws from those of Germany, when you access the Neocron Service you agree that the laws of Germany will apply to all matters relating to your use.
